Definitions

In this Privacy Policy “We”, “Us” and “Our” means Physits Pty Limited ACN 613 293 584  (Physits) of P.O Box 1122 Strathfield NSW 2135. Physits website (“Website”) and the Physits mobile Applications (the “App(s)”) (collectively, the Website(s), App(s) and other Physits-related services are referred to as “Services”). Both customers and service providers (“Therapists”) hereinafter shall be collectively referred to as “Users”.

Physits collects personally identifiable information, such as your name, username, email address, mailing address, phone number, photo (if you choose to provide it) and other personally identifiable information (“Personal Information”) when you sign up for or use the Services. Physits may request that Therapists provide:

(i) first and last name;
(ii) email address;
(iii) mailing address;
(iv) phone number;
(v) bank account number;
(vi) insurance details;
(vii) address of the bank account holder;
(viii) healthcare provider/healthfund policy number; and
(ix) ABN

Physits may request that Customers provide:

(i) first and last name;
(ii) email address;
(iii) mailing address;
(iv) phone number;
(v) date of birth;
(vi) massage preferences;
(vii) a copy of identification (such as a Driver’s License);
(viii) payment account information such as a credit card number with the name as shown on the card, expiration month and year and CVV; and
(ix) input on our Virtual Diagnostic feature to inform your therapist on the purpose and/or key areas of focus for your booking.

If you provide personal information to us about someone else, you must ensure that you are entitled to disclose that information to us and that, without us taking any further steps required by privacy laws, we may collect, use and disclose such information for the purposes described in this Privacy Policy. For example, you should take reasonable steps to ensure the individual concerned is aware of the various matters detailed in this Privacy Policy. The individual must also provide the consents set out in this Privacy Policy in respect of how we will deal with their personal information.

Our server automatically collects information about your use of the Software (Navigational Data). Navigational Data includes type of browser you are using, your IP address, the URL you have come from and the time spent at that URL, cookies and your domain type and server. This kind of information is collected by many software and mobile applications. We use this information only to identify ways to optimize your use of our Service. When you use our Software, cookies will be placed on your device to keep track of your use of our Software. Cookies do not capture or track any personal information. You may request at any time to have cookies removed on your device by contacting Us. If you do not provide the information requested by us, we may not be able to provide you with our services (either in your capacity as a customer or a Service Provider).

Permission to collect, store and use personal information is explicitly used in regard to obtaining and/or providing massage, physiotherapy or dry needling treatment. Personal information is collected for the express purpose of executing the booking of your work, for proper administration of the financial transactions, direct marketing and, where applicable, providing information for health rebate purposes. We may also collect other Personal Information from you when you access the Services and/or other parts of the Website and/or Apps, should you elect to provide Personal Information, for the purpose of improving the quality of Service that we provide.

From time to time we may use your personal information to provide you with current information about our Services, special offers you may find of interest, changes to our organisation, surveys for improving our Services, or new products or Services being offered by Us or any company We are associated with. By providing us with your personal information, you consent to us using your information to contact you on an ongoing basis for this purpose, including by mail, email, SMS, social media and telephone. If you do not wish to receive marketing services, you may at any time decline to receive such information by contacting us using the contact details below. We will take all reasonable steps to meet your request at the earliest possible opportunity.

From time to time we may establish a business relationship with third party businesses (“Service Providers”), deemed trustworthy and have privacy practices consistent with ours, including but not limited to marketing and promotion businesses and/or software specialists upgrading the databases. They may have access to this information under strict restrictions. We only provide our Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized access, use or disclosure. Service Providers are prohibited from using or disclosing Personal Information other than as specified by Physits.

It is important to our relationship that the personal information we hold about you is accurate and up to date. If at any time you are of the view that personal information about you is not accurate, complete or up to date, please write to us with your request for correction. Our policy is to consider any requests for correction in a timely manner.

Under the Privacy Act, you have a right to seek access to information which we hold about you (subject to the limited exceptions set out below). If you wish to exercise your right under the Privacy Act to seek access to the personal information that we hold about you, we ask that you write to us and we will explain how we handle your access request. We may charge you for the cost of providing access to these records.

There may be situations where we are not required to provide you with access to your personal information. For example, such a situation would be information relating to an existing or anticipated legal proceeding with you, or if your request is vexatious. An explanation will be provided to you if we deny you access to your personal information we hold.

We do not sell, rent or trade personal information to or with third parties. By providing us with your personal information, you consent to us disclosing your information to our Service Providers and/or Third Party Entities, for the purposes described above, without obtaining your consent on a case by case basis.

We will take all reasonable steps via physical, electronic, and procedural safeguards in an effort to protect the confidentiality and security of Personal Information in our custody and control. However, no data transmission over the Internet or other networks can be guaranteed to be 100% secure. As a result, although we strive to protect information transmitted on or through the Services, we cannot and do not guarantee the security of any information you transmit on or through the Services, and you do so at your own risk.
